The winner of the Competition (‘the Winner’) will be selected at random from all Entrants and across all relevant platforms, using third party software. Please note that there can be only one Winner of the Competition. The Promoter will select and notify the Winner within 7 days of the end of the Entry Period. On the Promoter’s request and at the Promoter’s discretion, the Winner must provide adequate evidence of their compliance with the eligibility conditions set out in Clause 2. If the Winner is unable to prove their eligibility to the Promoter’s reasonable satisfaction, the entry will be void and the Promoter will select another Winner, adjusting the timescales set out in this clause in a proportionate manner.
The Winner must provide their name, email address, and phone number to the Promoter if requested. The Promoter reserves the right to share this information only to the extent necessary to enable delivery of the Prize and for no other purposes.
The Promoter will transfer the Prize to the Winner via PayPal or bank transfer within 28 days of receiving the Winner’s PayPal email address subject to satisfactory compliance with all the eligibility conditions set out in Clause 2. It’s important to note that there is only one Prize for the Competition, which will be awarded to one Winner. The Prize is non-negotiable, non-transferable, and non-refundable. To the extent permitted by applicable law, the Promoter and the Sponsor’s liability under or in connection with the competition or these Terms and Conditions shall be limited to the cost price of the Prize.
To the extent permitted by applicable law, the Promoter and the Sponsor shall not be liable under or in connection with these Terms and Conditions, the Competition or the Prize for any indirect, special or consequential cost, expense, loss or damage suffered by the Entrant even if such cost, expense, loss or damage was reasonably foreseeable or might reasonably have been contemplated by the Promoter and the Sponsor whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise.
In the event that any provision of these Terms and Conditions is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.
The Competition is governed by the laws of England and Wales, without respect to conflict of law doctrines. By participating in the Competition, you agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with the Competition, shall be resolved individually, without resort to any form of class action, exclusively before a court located in England and Wales having jurisdiction. Further, in any such dispute, under no circumstances shall you be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than actual out-of-pocket expenses (i.e. costs associated with entering the competition).
